Terms of Service
These Terms of Service govern your use of the Ignixn platform and website. By signing up for or using Ignixn, you agree to these terms. If you do not agree, please do not use the service.
What Ignixn Provides
Ignixn is an AI-powered website platform that builds, hosts, and manages websites for local service businesses. Services are provided on a month-to-month subscription basis and include website generation, managed hosting, SEO guard rails, AI content generation, and location-based ranking pages. Feature availability may change as the platform develops. We will communicate material changes to active subscribers in advance.
Your Account and Content
You own your content. The business information, copy, images, and materials you provide to Ignixn remain yours at all times. Ignixn does not claim ownership over any content you create, upload, or publish through the platform.
Ignixn owns the platform itself: the AI systems, SEO architecture, software, and tooling that generate and manage your website. Your subscription gives you the right to use that platform, not to acquire ownership of it.
You are responsible for ensuring that content you publish through Ignixn does not infringe on any third-party intellectual property rights, violate any laws, or misrepresent your business.
Payments and Billing
Subscriptions are billed monthly on the date you first subscribed. Payment is processed through Stripe, a Level 1 PCI DSS compliant payment processor certified to PCI Service Provider Level 1. Ignixn does not store your payment card information. By subscribing you agree to Stripe's terms of service.
Founding members who subscribe during the early access period lock in the $300/month rate permanently for as long as they remain continuously subscribed. If a founding member cancels and later resubscribes, the founding member rate no longer applies and the current pricing at that time will apply.
If a payment fails, we will notify you by email and attempt to retry. If payment cannot be collected within 7 days of the failure, your account may be suspended until the balance is resolved.
Cancellation and What Happens After
You may cancel your subscription at any time with no cancellation fee. Your service remains active through the end of the current billing period. At the end of that period:
- Your Ignixn-hosted website will go offline
- Your account data is retained for 60 days in case you choose to reactivate
- After 60 days, your data is deleted from our systems
If you use your own custom domain, pointing it elsewhere is your responsibility after cancellation. Ignixn does not hold your domain and cannot prevent you from redirecting it.
Acceptable Use
You agree not to use Ignixn to:
- Publish false, misleading, or fraudulent content about your business or services
- Publish content that infringes on third-party intellectual property or trademarks
- Distribute spam, malware, or any content designed to deceive or harm visitors
- Violate any applicable local, state, or federal laws
Ignixn reserves the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.
Service Availability
Ignixn operates on Cloudflare's infrastructure and targets high availability, but we make no uptime guarantee or service level agreement. We are not liable for losses resulting from downtime, outages, or service interruptions, whether planned or unplanned.
SEO and Ranking Outcomes
Ignixn builds websites structured for search engine optimization, but we make no guarantees about specific ranking outcomes. Search engine algorithms are outside our control and change frequently. Results vary based on your industry, location, competition, and many other factors. Our commitment is to build and maintain a technically sound, SEO-compliant website on your behalf. We cannot promise specific traffic, ranking positions, or lead volume.
Limitation of Liability
Ignixn is provided "as is" and "as available." To the fullest extent permitted by applicable law, Ignixn LLC and its founders, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including lost revenue, lost rankings, or business interruption.
In any case, Ignixn's total liability to you for any claim arising under these terms is limited to the subscription fees you paid to us in the 30 days immediately preceding the event giving rise to the claim.
Dispute Resolution
Any dispute arising out of or relating to these Terms of Service or your use of Ignixn shall first be addressed through good-faith negotiation between the parties. If negotiation does not resolve the dispute within 30 days, both parties agree to binding arbitration under the rules of the American Arbitration Association, conducted in Waynesboro, Virginia. You waive any right to pursue claims as part of a class action.
Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Intellectual Property
The Ignixn name, logo, platform software, AI systems, and all associated trademarks and trade dress are the property of Ignixn LLC. Nothing in these terms grants you any rights in Ignixn's intellectual property beyond the limited right to use the platform as a subscriber.
Changes to These Terms
We may update these terms as the platform evolves. Active subscribers will be notified by email at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
